Strengthening the role of the Ministry of Foreign Affairs through the establishment of treaty administration unit
The Ministry of Foreign Affairs carries the general role as the coordinator and advisor on the conduct of foreign relations of Indonesia. The Ministry has also specific role relating to the treaty making process and administration as provided by the Vienna Convention on Law of Treaties and a number of national legislations. These roles bring about certain functions that should be carried out effectively by the Ministry as they involve with legal obligations under international law and various national legislations.
The objective of this paper is to conduct an analysis of the role and function relating to the administration of treaties and provide policy options that is aimed at strengthening the role of the Ministry of Foreign Affairs. It is hoped that the upcoming reorganization of the Ministry in the future will accommodate the recommendations provided in the paper.
This paper identifies the functions concerning treaty administration and its related functions (Chapter II), evaluating how the present structure of the Ministry of Foreign Affairs copes with these functions (Chapter III) and offers a policy alternative to establish a treaty administration unit under the Directorate General of Legal Affairs and Treaties that is aimed to further strengthen the role of the Ministry of Foreign Affairs (Chapter IV). There is a great momentum in which strengthening Indonesia’s diplomacy infrastructure is part of the current focus of diplomacy, along with the support from the House of Representatives for a Minimum Diplomacy Infrastructure.
