Subsidies and international trade: A European lawyers' perspective

This book consists of a collection of papers presented, commented upon and discussed at a symposium organized at the College of Europe (Bruges, Belgium) in November 1989. The topics that were selected are only part of the legal and policy issues and maybe some of these issues deserved to be dealt with more in depth. But this is a first attempt to come to grips with them in a public discussion in the European Community in a forum comprising academics, private practitioners and public servants. We are grateful to all of them for having given some of their undoubtedly precious time to write these

papers and comments. The European Community Institutions have actively contributed to the negotiations that led to the Tokyo Round Subsidies Code and are deeply involved in the Uruguay Round negotiations on this topic as on others. In this respect the papers and comments of this book will confirm that within the European Community as well the subject matter of subsidies in international trade gives rise to perplexities and controversies.

On the other hand, little use has been made so far in the European Community of the possibility to countervail subsidized imports. There are several reasons. One of them is the strict interpretation followed by the European Community Institutions in implementing Article VI of the GATT and the relevant provisions of the GATT Subsidies Code. The question is whether and for how long such course of action will remain feasible and advisable if the US were to apply, in politically sensitive cases, to EC exports its policy of interpreting broadly these international provisions. From that point of view time has come to take stock. Some of the papers of this book could be useful in this respect. Another reason is the lack of sufficient knowledge on the part of many practitioners and of their clients. Being the first book dealing with this subject matter in the European Community, this collection of papers and comments should be of some help to them.
