Protecting the rights of Indonesian migrant workers through itsbat Nikah: A study case in Tawau
The importance of a marriage record is not only as a statement that the marriage is legal in the eyes of the state, but its legality status will also affect the status of children, spouse, and assets, during the marriage. Yet, many Indonesian migrant workers are unaware that the recording of the marriage has a profound effect on other aspects of family law, such as marital status, child status, and other administration such as childbirth certificate and passport. The lack of knowledge and understanding of Indonesian migrant workers on the urgency of marriage registration and lawful marriage procedure is due to their low level of education. This paper will dwell into such situation in Tawau, Malaysia and explore the importance of registering the migrant worker’s marriage. This policy paper is divided into three parts. The first part corresponds to the conceptual framework, including presenting the main concepts. The second part analyses the importance of marriage records and Itsbat Nikah, including its challenges and opportunities. In the last part, this paper will offer solutions to tackle the challenges of helping Indonesian migrant workers in Tawau to register for their marriage. This paper will also highlight the roles of the Consulate of the Republic of Indonesia in Tawau (KRI Tawau) in protecting the rights of Indonesian citizens through Itsbat Nikah.
