Navigating the murky waters of IUU fishing: Indonesia's policy options through Indian Ocean Rim Association
Being one of the largest maritime countries in the Indian Ocean, Indonesia has a crucial role in addressing IUUF in the region. In pursuit of this objective, Indonesia has collaborated closely with many international and regional organizations, such as the IORA. With the aim of fostering regional partnerships in the Indian Ocean Region, Indonesia played a significant role in initiating and creating the Cluster Group on Fisheries Management (CGFM), which was endorsed as a functional body of IORA during the Council of Ministers Meeting in 2020. Indonesia has been the chair since its inception.
While IORA recognizes the threat of IUU fishing, its current approach is limited, and stronger, coordinated action is needed. Indonesia should take a leadership role in proposing a regional instrument through IORA to combat IUU fishing and ensure sustainable fisheries management. To effectively combat IUUF, Indonesia aims high to propose a legally binding instrument in the future. Such an instrument could provide a more robust legal framework for member states to fight IUUF and ensure sustainable fisheries management in the region.
Nonetheless, after examining four potential scenarios for combatting fisheries crime in the Indian Ocean region, and given that the IORA member countries are currently not fully committed to fighting IUU fishing, but the region is relatively stable, it would be more viable to begin by proposing a regional guideline as the initial step towards creating a legally binding instrument. A regional guideline can act as a soft law mechanism that enables member states to collaborate and coordinate with each other. In addition, it can lay the groundwork for future discussions on a legally binding instrument. Simultaneously, Indonesia should take measures to prepare for submitting a legally binding instrument proposal in the future.
To effectively propose an IORA regional guideline in combatting IUU fishing and lay the groundwork for proposing a future legally binding instrument, Indonesia can leverage its position as the chair of the CGFM. To this end, a set of strategic actions are recommended to be undertaken within the purview of the CGFM.
