Progressing ASEAN decision making when consensus cannot be achieved
ASEAN Charter provides that as a basic principle, decision-making in ASEAN shall be based on consultation and consensus. It further dictates that when consensus cannot be achieved, the ASEAN Summit may decide how a specific decision can be made. Yet, there has not been any guidance as to how such arrangement could be operationalized, especially when the Summit is faced with a situation that requires urgent and immediate response. Even more when the Summit itself is hindered by the inability to mold consensus.
A mechanism must therefore be developed to address such unfortunate circumstances and to eventually strengthen ASEAN decision-making mechanism. For there are at least six occasions which are explicitly mentioned by the Charter where the Summit is expected to offer its resolve on matters brought to its attention. In the ultimate analysis, the strengthening of ASEAN decision-making mechanism will not only enhance the relevance and performance of the Association itself but will also serve Indonesia’s national interests.
