Harmonized intellectual property law between ASEAN Member States (AMS) as a Requirement for an effective ASEAN Economic Community (AEC): Achieving harmonized intellectual property law, the ASEAN Way
The establishment of the ASEAN Economic Community (AEC) highlights the need to harmonize intellectual property (IP) law among ASEAN Member States, particularly in the areas of protection, administration, and enforcement. Harmonization efforts began in 1995 but continue to face challenges because legal alignment remains a sensitive issue in regional integration. Developments in international IP regimes, particularly the *Trade-Related Aspects of Intellectual Property Rights* (TRIPS) Agreement and conventions administered by the World Intellectual Property Organization (WIPO), have encouraged greater policy convergence among member states. However, disparities in IP protection and enforcement may result in inconsistent judicial decisions when resolving cross-border disputes. Such inconsistencies can undermine legal certainty and rightsholders’ confidence in conducting economic activities within ASEAN. Therefore, an approach to IP law harmonization is needed that accommodates differences among national legal systems while supporting economic integration through cooperation mechanisms suited to ASEAN’s regional characteristics.
