Redesign local staff management system: In supporting the achievement of Indonesian missions’ goals
This paper examines the need for Indonesia’s Ministry of Foreign Affairs to redesign the management system for locally recruited staff at Indonesian missions abroad. The increasing number of cases filed by local staff is a concern because disputes between missions and their employees are time-consuming, adversarial, and costly. The analysis suggests that regulations and practices may conflate administrative and technical staff or consular employees with locally recruited staff. This misconception can contribute to ineffective and inefficient management and complicate the legal framework governing employment relationships. Reform should begin by redefining the concept of local staff in line with international law and the common practices of other states. In addressing disputes, the Ministry should also take account of the development of immunity principles, particularly the protection of local employees’ human rights, and should not assume that Indonesian missions are immune from local jurisdiction. Employment contracts should take local labor laws into account, and compliance with the receiving state’s laws and regulations is part of the duty of all foreign missions.
