Exploring the possibility of amending the general agreement on development cooperation between the Government of the Republic of Indonesia and the Government of Australia
The General Agreement on Development Cooperation between the Government of Australia and the Government of the Republic of Indonesia (“GADC”) has not been amended since it was signed in 1998 and entered into force since 1999. It contains provisions that are outdated and references to laws and regulations that the Indonesian Government have amended. Meanwhile, the GADC continues to become the basis for Australian development activities and is referred in technical Memoranda of Understanding, Technical Arrangements, and other forms of bilateral cooperation between institutions of the two countries.
In light of the Australian Government announcing its new International Development Policy and Development Finance Review on 8 August 2023, discussions should be initiated to review the GADC and its provisions to ensure it remains relevant to the interest of both countries today. Both countries also need to explore the possibility of amending to provisions that are no longer relevant and updates must be made to allow for a more applicable legal basis for Indonesia and Australia’s development cooperation.
