Advancing development agenda in the World Trade Organization: Securing national policy on raw materials
Indonesia’s raw materials downstream policy, particularly the prohibition on nickel ore exports and the domestic processing requirement, has faced challenges following a dispute filed by the European Union at the World Trade Organization (WTO). The WTO Panel found that the measures were inconsistent with the WTO principle concerning the general elimination of quantitative restrictions, creating legal challenges for Indonesia’s downstream policy. The document discusses the implications of the Panel’s decision, relevant WTO rules, and ongoing negotiations concerning raw materials. It also highlights the need for a multi-period strategy to address the legal and regulatory challenges and to support the continued implementation of Indonesia’s national policy on raw materials downstreaming within the WTO framework.
