Toward a rule-based consular assistance framework: Managing Moral Hazard in State-Facilitated Repatriation of Indonesian Nationals
The protection of Indonesian nationals abroad faces growing governance challenges arising from increasingly complex consular cases, inconsistent handling across diplomatic missions, and gaps between public expectations and state authority. This paper identifies the need for an integrated operational framework that clarifies the scope, limitations, and prioritization of consular assistance. It recommends establishing a National Consular Assistance Framework (NCAF), integrating repeat-case tracking into the Ministry of Foreign Affairs’ existing consular database, and introducing tiered case classification and inter-agency escalation mechanisms. Implementation should proceed through phased regulatory reform, operational guidelines, staff training, and strengthened coordination with Immigration authorities. These measures aim to improve the consistency, fairness, credibility, and sustainability of Indonesia’s consular protection system while reaffirming the state’s responsibility to safeguard its nationals abroad.
